Elder Law & Medicaid Assistance
What is Elder Law?
At the Law Offices of Samantha J Fitzgerald, our Elder Law practice focuses on getting our clients and their families get long-term care.
From assisted living facilities and nursing homes, to live-in help for your own home, we help you and your loved ones qualify for governmental benefits to get the long-term care that is needed.
What If You Already Have Medicare?
Long-term care for your aging loved one can be tremendously expensive. Just a few years of paying for long-term care can wipe out your loved one’s life savings. Many people are surprised to learn that Medicare does not pay for long-term care. Medicare primarily pays for hospitalization, rehabilitation, physician visits, durable medical equipment and hospice services.
What is Medicaid?
Medicaid is a need-based program and recipients must qualify under both the asset test and the income test. In addition, you must need “nursing facility level of care”. This does not necessarily mean that the care recipient requires nursing or skilled medical services. Florida uses a standardized in-person exam to understand the degree to which the applicant needs assistance or partial assistance to complete two or more of activities of daily living. Examples include bathing, personal hygiene, eating, and mobility. In the case of Alzheimer’s and dementia care patients who do not have any physical limitations, the state also recognizes the need for supervision of individuals who have several memory impairments.
How Can You Qualify for Medicaid?
This is how the Law Offices of Samantha J Fitzgerald can help!
While most of our clients do not initially qualify for Medicaid, there are many legal strategies to help those that do not meet the asset and income qualification requirements.
